Former Mainstreet Gourmet Bakery employee claims she wasn't paid overtime wages

MIAMI – A former bakery employee alleges that she was not paid overtime wages.

Jeanne Paul filed a complaint on April 19 in the U.S. District Court for the Southern District of Florida against Best Baked Goods Inc., doing business as Mainstreet Gourmet Bakery, John T. Gerecs and Edward Gerecs, alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendants from March 2006 to May 2015. She alleges that she was paid an hourly wage of $8 per hour, which was later changed to $400 per week. She claims she worked in excess of 40 hours per week but was not properly compensated at the statutory rate of time-and-one-half of her regular rate. The plaintiff holds Best Baked Goods, John T. Gerecs and Edward Gerecs responsible because the defendants allegedly willfully failed to pay her lawfully earned wages, operated their business with a policy of not paying wages in conformance with the law and failed to properly disclose or apprise her of her rights under the FLSA.

The plaintiff requests a trial by jury and seeks declaration that the defendants violated the overtime provisions of the FLSA, compensation for unpaid wages, liquidated damages, attorney’s fees and costs, post-judgment interest and any other and further relief the court may deem just and proper. She is represented by Peter Bober of Bober & Bober PA in Hollywood.
