Lee County employers accused of not paying minimum wage, overtime

FORT MYERS – Two Lee County residents allege that their former employers did not pay them all wages owed.

Jessica Forit and Christopher Forit filed a complaint on April 20 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against Mo Management LLC; Atlantic Media Source Inc., doing business as North American Direct Services; Phoenix Marketing and Management LLC; Duktack Bresnik and Michael Oelrich alleging that they willfully violated the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that they were not properly compensated in one or more weeks during their employment. The plaintiffs hold the defendants responsible because the defendants also allegedly failed to compensate them the applicable minimum wage for one or more weeks and failed to compensate them at a rate of time-and-one-half of their regular rate for all hours worked in excess of 40 hours per week.

The plaintiffs request a trial by jury and seek compensation for all unpaid wages, liquidated damages, attorney fees and costs and all other relief as the court may deem just and proper. They are represented by Bradley P. Rothman of Weldon & Rothman PL in Naples.
