MIAMI – A former Southcoast Health Systems Inc. employee alleges that her insurance company initially approved long-term disability benefits and then wrongfully terminated them.
Maureen Ebbs filed a complaint on April 15 in the U.S. District Court for the Southern District of Florida against The Lincoln National Life Insurance Co. alleging that the insurer of benefits violated the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that she was initially approved but stopped receiving her benefits under the long-term disability plan in May 2013. She alleges she has been damaged for loss of disability benefits. The plaintiff holds The Lincoln National Life Insurance Co. responsible because the defendant allegedly wrongfully terminated her claim for benefits, failed to properly and adequately investigate the merits of her disability claim and failed to provide a full and fair review to her appeal.
The plaintiff requests a trial by jury and seeks order declaring that she is entitled to immediate reinstatement to the plan, compensation for disability benefits due, all costs and attorneys’ fees, prejudgment and post-judgment interest and for such other and further relief as the court may deem just and proper.
