Consumer files suit against debt collector over credit report

TAMPA – A Hillsborough County woman alleges that a disputed debt wasn't removed or marked as such on her credit report.

Liriana Ruiz filed a complaint on April 15 in the Tampa Division of the Middle District of Florida against Stellar Recovery Inc. alleging that the debt collector violated the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that she sent a dispute letter regarding a purported debt in to the defendant in December 2015. The plaintiff holds Stellar Recovery Inc. responsible because the defendant allegedly failed to remove the allege debt from her credit report and failed to mark it as "disputed by costumer," despite being required by law.

The plaintiff requests a trial by jury and seeks compensation for actual and statutory damages, attorney's fees and costs and for any other relief as the court may deem just and proper. She is represented by Michael J. Ringelheim of RC Law Group PLLC in Hackensack, New Jersey.
