Woman alleges benefits were wrongfully terminated by Prudential

ORLANDO A disabled Palm Bay woman alleges that her long-term disability benefits were wrongfully terminated after receiving them for almost three years.

Patty Raymond filed a complaint on April 15 in the U.S. District Court for the Middle District of Florida, Orlando Division against The Prudential Insurance Co. of America alleging that the insurer of benefits violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she has been unable to work since 2012 and received benefits from the defendant through March 31, 2015, when the benefits were terminated. The plaintiff holds The Prudential Insurance Co. of America responsible because the defendant allegedly breached its duty under the terms of the long-term disability policy, wrongfully terminated her claim for benefits, denied her appeal, ignored the medical opinions of her physicians and relied only on the opinion of its own medical consultants.

The plaintiff requests a trial by jury and seeks compensation for unpaid benefits plus interest, attorneys' fees and costs and for such other and further relief that the court may deem just and proper. She is represented by Edward Philip Dabdoub and Carter E. Meader of Wagar Dabdoub PA in Coral Gables.
