LINA accused of wrongfully terminating benefits

MIAMI – A registered nurse alleges her long-term disability benefits were wrongfully terminated.

Colleen Besche filed a complaint on April 15 in the U.S. District Court for the Southern District of Florida, Miami Division against Life Insurance Co. of North America alleging that the plan administrator violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that since July 21, 2015, she has not received her benefits under the long-term disability plan after initially receiving them since 2011. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly terminated her claim for long-term disability benefits, breached the terms of the long-term disability policy, relied only on the views of its own medical consultants and failed to discharge its duties in respect to discretionary claims.

The plaintiff requests a trial by jury and seeks compensation for unpaid benefits plus interest, attorney’s fees and costs and for such other relief as the court deems just and proper. She is represented by Edward Philip Dabdoub and Geannina Burgos of Wagar Dabdoub PA in Miami.
