Man files suit for disability benefits from Metropolitan Life Insurance

Insurance 09

JACKSONVILLE – A Hamilton County man alleges he was wrongfully denied short and long-term disability benefits.

Walter Weise filed a complaint on April 15 in the U.S. District Court for the Middle District of Florida Jacksonville Division against Metropolitan Life Insurance Co. and PCS Administration (USA) Inc. alleging that they violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he has not received both his benefits under the short-term disability plan and under long-term disability plan. The plaintiff holds Metropolitan Life Insurance Co. and PCS Administration Inc. responsible because the defendants allegedly failed to comply with the Employee Welfare Benefit Plan, denied his claim for short-term disability, failed and refused to consider his claim for long-term disability benefits and failed and refused to consider his administrative appeals.

The plaintiff requests a trial by jury and seeks compensation for unpaid benefits due, attorney's fees and costs for this action. He is represented by Herbert M. Hill of Herbert M. Hill PA in Orlando.
