Disabled man alleges Tamarac Cafe Diner discriminated against him

MIAMI – A disabled Broward County man alleges a Tamarac restaurant discriminated against him by denying safe and full access to its property.

Julius Seiler filed a complaint on April 14 in the U.S. District Court for the Southern District of Florida against American Projects Investments Corp., doing business as Tamarac Cafe Diner, alleging violation of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that on March 12, he visited defendant's facility but was denied safe, full and equal access and full and equal enjoyment of the facilities, services, goods, amenities and accommodations offered within and therefore suffered and continues to suffer from discrimination and injury. The plaintiff holds American Projects Investments Corp. responsible because the defendant allegedly failed to remove architectural barriers to access the restroom for disabled persons and failed to provide restrooms that are readily accessible to and usable by individuals with disabilities.

The plaintiff requests a trial by jury and seeks declaration that defendant's facility is in violation of the ADA, an order requiring the defendant to alter the property to make it accessible to and usable by individuals with disabilities, an order directing defendants to evaluate its policies and procedures toward persons with disabilities, attorneys' fees, costs, expenses and for such other further relief as the court may deem necessary.
