Man alleges Orwall Industries Inc. is not ADA compliant

MIAMI – A partial quadriplegic alleges that a Miami business has barriers that restrict access to the disabled.

Christopher Hansen filed a complaint on April 13 in the U.S. District Court for the Southern District of Florida against Orwall Industries Inc. alleging that the property owner has discriminated against him by failing to comply with the Americans with Disabilities Act requirements.

According to the complaint, the plaintiff alleges that he encountered barriers to access the facility and was denied safe access to, and full and equal enjoyment of the goods, services, and/or accommodations offered at the facility. As a result, he alleges he has suffered and continues to suffer direct and indirect injury. The plaintiff holds Orwall Industries Inc. responsible because the defendant allegedly failed to provide adequate accessible parking space, failed to properly mark the access aisle and failed to provide a dining area and comfort rooms accessible to and usable by persons with disabilities.

The plaintiff requests a trial by jury and seeks injunction enjoining defendant from continuing its discriminatory practices, an order for defendant to remove the physical barriers to access and alter the facility to make it readily accessible to and useable by individuals with disabilities, reasonable attorney’s fees, expert fees, costs and expenses incurred in this action.
