MIAMI – A Carnival Miracle passenger is suing the cruise ship's operator alleging he was injured due to the operator's negligence.
Moheb Mosaad filed a complaint on April 12 in the U.S. District Court for the Southern District of Florida, Miami Division against Carnival Corp. doing business as Carnival Cruise Lines, alleging negligence.
According to the complaint, the plaintiff alleges that on April 19, 2015, he slipped and fell on the steps of the staircase adjacent to a hot tub on Deck Nine, causing him to suffer severe, debilitating and permanent injuries to both of his shoulders. The plaintiff holds Carnival Cruise Lines responsible because the defendant allegedly failed to select walking surface materials which are reasonably safe, failed to make the walking surface of the subject steps dry and safe, failed to exercise reasonable care for the safety of its passengers and failed to implement a method of operation which was reasonable and safe to prevent dangerous conditions.
The plaintiff requests a trial by jury and seeks compensation for all damages, all court costs, all interest and any and all other damages which the court may deem just or appropriate. He is represented by John H. Hickey of Hickey Law Firm PA in Miami.
