MIAMI – A former DDI Vantage employee claims she was wrongfully denied benefits.
Jayne Bishop filed a complaint on April 11 in the U.S. District Court for the Southern District of Florida against United of Omaha Life Insurance Co., alleging that the plan administrator violated the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that she became disabled on Sept. 3, 2014, and was denied benefits by the defendant under the long-term disability policy. As a proximate result of defendant's wrongful conduct, she alleges she has suffered damages for loss of disability benefits in a total sum to be determined at trial. The plaintiff holds United of Omaha Life Insurance Co. responsible because the defendant allegedly has refused to pay her benefits under long-term disability plan, failed to provide a prompt and reasonable explanation of the basis for its denial of her claim, failed to properly and adequately investigate the merit of her claim.
The plaintiff requests a trial by jury and seeks compensation for disability benefits due, an order for her immediate reinstatement to the long-term disability plan, attorneys’ fees, all costs, prejudgment and post-judgment interest and such other and further relief as the court may deem just and proper.
