MIAMI – A man alleges a Miami property has barriers that prohibit access to the disabled.
Renzo Barberi filed a complaint on April 12 in the U.S. District Court for the Southern District of Florida against Evapors LLC and Alfredo Martin Properties Inc. alleging violation of the Americans with Disabilities Act.
According to the complaint, the plaintiff alleges that he encountered architectural barriers at the defendants' property and was denied safe access to and full and equal enjoyment of goods, services and accommodations being offered at the facility. The plaintiff holds Evapors LLC and Alfredo Martin Properties Inc. responsible because the defendants allegedly do not provide compliant parking spaces, signage and other items.
The plaintiff requests a trial by jury and seeks declaration that defendants' facility is in violation of ADA regulations, an order requiring defendants to alter the subject facility to make it accessible to and usable by individuals with disabilities, an order directing the defendants to evaluate and neutralize their policies and procedures toward persons with disabilities, attorney's fees and costs and any other and further relief as it deems necessary, just and proper.
