JACKSONVILLE – A collections agent alleges her former employer did not pay overtime wages.

Shermanita McCants filed a complaint on April 13 in the U.S. District Court for the Middle District of Florida Jacksonville Division against Enhanced Recovery Co. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she worked for more than 40 hours per week during her employment with the defendant without proper compensation. The plaintiff holds Enhanced Recovery Co. responsible because the defendant allegedly failed to compensate her at a rate of one-and-one-half of her regular rate for each hour worked in excess of 40 per week, refused to pay her for her extra Saturday work and failed to maintain proper time records.

The plaintiff requests a trial by jury and seeks declaration that defendant's practices violated the FLSA, compensation for overtime wages due, liquidated damages, attorney's fees and costs, prejudgment interest and any further relief that the court may deem just and proper. She is represented by Richard Celler of Richard Celler Legal PA in Davie.
