MIAMI – An individual with injuries has filed suit against three Margate businesses alleging that they have discriminated against him by denying safe and full access to their properties.
Julius Seiler filed a complaint on April 12 in the U.S. District Court for the Southern District of Florida against Carolina Springs Plaza; Y&I Group LLC, doing business as Jr Pizza Bella Restaurant; and El Bodegon Grocery No. 3 Inc., doing business as Supermercados El Bodegon, citing violation of the Americans with Disabilities Act.
According to the complaint, the plaintiff alleges that on April 9, he was denied safe full and equal access and full and equal enjoyment of the facilities, services, goods and amenities within the defendants' facilities. The plaintiff holds Carolina Springs Plaza, Jr Pizza Bella Restaurant and Supermercados El Bodegon responsible because the defendants allegedly failed to remove barriers in the restrooms, failed to provide a restroom that is accessible to and usable by individuals with disabilities, failed to provide proper signage for an accessible restroom or failure to redirect disabled persons to the closest available accessible restroom and failed to provide parking for disabled persons.
The plaintiff requests a trial by jury and seeks a declaration that the subject facilities are in violation of the ADA, an order requiring defendants to alter the properties to make them accessible to and usable by individuals with disabilities, an order directing defendants to evaluate their policies and procedures toward persons with disabilities, attorney's fees, costs, expenses and for such other further relief as the court may deem necessary.
