Toilet light marketer accuses Ontel Products Corp. of trademark infringement

FORT LAUDERDALE – A Sunrise toilet light maker is suing a New Jersey corporation alleging that it is selling a similar product and infringing a patent.

Glow Bowl LLC filed a complaint on April 12 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Ontel Products Corp. alleging violation of the Florida Unfair and Deceptive Practices Act, unfair competition and other counts.

According to the complaint, the plaintiff alleges it sells the Glowbowl light and that the defendant sells a similar product called Bowl Light. The plaintiff alleges that it has suffered loss of income, profits, goodwill and has been irreparably harmed of its valuable trademark and patent rights. The plaintiff holds Ontel Products Corp. responsible because the defendant allegedly directly infringed the plaintiff's '298 patent for a motion-activated toilet bowl lighting device; falsely and fraudulently advertised that it is selling original Glowbowl; and never requested permission to design, manufacture, sell or offer for sale toilet lights that infringe the ‘298 patent.

The plaintiff requests a trial by jury and seeks a preliminary and permanent injunction enjoining defendant's infringement, compensation for damages no less than a reasonable royalty, attorney’s fees and costs, prejudgment interest and for such other and further relief as is just and proper.
