FORT MYERS – A former foam installer/technician of a North Port insulation company alleges he has suffered damages due to unpaid wages.
Jeffrey Mauger filed a complaint on April 11 in the U.S. District Court for the Middle District of Florida Fort Myers Division against JW Insulation LLC citing violation of the Fair Labor Standards Act, breach of contract and failure to pay wages.
According to the complaint, the plaintiff alleges that between May 2014 and February, he did not receive payment for overtime work at a rate of time-and-one-half of his regular rate for all hours worked in excess of 40 per week. The plaintiff holds JW Insulation LLC responsible because the defendant allegedly failed to pay overtime compensation in a lawful manner and wrongfully deprived him of his wages that were due and owing.
The plaintiff requests a trial by jury and seeks compensation for unpaid overtime wages, liquidated damages, attorney's fees, costs and expenses, post-judgment interest and for any further relief that the court may deem just and proper.
