Maintenance worker alleges Avesta Homes misclassified home from receiving overtime

TAMPA – A Hillsborough County man alleges that his employer has not properly paid him for all hours worked.

Clifford Bradley filed a complaint on May 7 in the Tampa Division of the Middle District of Florida against Avesta Homes LLC alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff has been an employee of the defendant since 2011 as a maintenance worker. He alleges that he was not properly compensated for all overtime hours he performed during his employment. The plaintiff holds Avesta Homes LLC responsible because the defendant allegedly misclassified him as an exempt employee and failed to compensate him at a rate of time-and-one-half of his regular rate for all hours worked in excess of 40 per week.

The plaintiff requests a trial by jury and seeks compensation for all unpaid wages, liquidated damages, prejudgment interest, attorney's fees and costs and for such other relief as the court may deem just and equitable. He is represented by Brandon J. Hill of Wenzel Fenton Cabassa PA in Tampa.
