Security officer alleges Pacific Tomato Growers owes him unpaid wages

TAMPA – A security officer has filed a class-action lawsuit his former employers over allegations that he was misclassified from receiving overtime wages.

Clarence Wingard filed a complaint on behalf of all others similarly situated on April 7 in the Tampa Division of the Middle District of Florida against Pacific Tomato Growers LTD and PTG Management Co. alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours during one or more work weeks without proper overtime pay. The plaintiff holds Pacific Tomato Growers LTD and PTG Management Co. responsible because the defendants allegedly misclassified him as an exempt employee, failed to pay the correct overtime rate for all hours worked and failed to keep proper time records.

The plaintiff requests a trial by jury and seeks compensation for all overtime wages due, an equal amount in liquidated damages, attorney's fees and costs and for such other and further relief as permitted by law. He is represented by Christina J. Thomas of Morgan & Morgan PA in Orlando.
