Flower company files suit against Miami man alleging copyright infringement

FORT LAUDERDALE – A sculptural flower company alleges that a Miami individual and an Arkansas business unlawfully reproduced photographs without permission.

Fleurissma Inc. filed a complaint on April 6 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Adrian Garcia, Winstream Holdings Inc. John and Jane Doe 1-10 citing copyright infringement.

According to the complaint, the plaintiff alleges that it has suffered, and will continue to suffer, substantial losses, including but not limited to damage to its business reputation and good will. The plaintiff holds Adrian Garcia, Winstream Holdings Inc. John and Jane Doe 1-10 responsible because the defendants allegedly reproduced, distributed and publicly displayed 14 photos copied from its catalogue, used the copyrighted photos on its website and sold counterfeit products bearing the Emilio Robba, the plaintiff's owner, trademark.

The plaintiff requests a trial by jury and seeks an injunctive relief enjoining defendants from further act of trademark dilution, compensation for all damages and any other additional relief as proper. It is represented by Divya Khullar of Khullar PA in Tamarac.
