Miami-Dade County resident accuses Amscot Corp. of gender discrimination

MIAMI – An assistant manager alleges her former employer terminated her because of her pregnancy.

Andrea Zapata filed a complaint on April 6 in the U.S. District Court for the Southern District of Florida against Amscot Corp. citing gender discrimination.

According to the complaint, the plaintiff alleges that on or about Dec. 13, 2014, she was hospitalized with pregnancy complications and advised her district manager that she was placed on bed rest for two to four weeks. She alleges the defendant's human resources department told her she qualified for short-term disability. On Jan. 29, 2015, she was allegedly fired. The plaintiff holds Amscot Corp. responsible because the defendant allegedly terminated and subjected her to disparate treatment because of her gender and replaced her with a male employee.

The plaintiff requests a trial by jury and seeks a declaration that the acts and practices of defendant are in violation of the law; an injunctive relief enjoining and permanently restraining these violations; compensation for damages past, present and future; mental anguish; pain and suffering and humiliation; reasonable attorney's fees and costs and such other and further relief as the court may deem just and proper.
