Man alleges S.W. Cole Inc. did not pay him overtime wages

OCALA – A man has filed a suit against his former pest control employer over allegations he was not paid overtime wages during his employment.

Anthony Miller filed a complaint on April 6 in the U.S. District Court for the Middle District of Florida, Ocala Division against S.W. Cole Inc. and Jerry E. Cole alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between June 6, 2014, and Nov. 11, 2015, he did not receive any compensation for all hours he worked in excess of 40 hours in a single week. The plaintiff holds S.W. Cole Inc. and Jerry E. Cole responsible because the defendants allegedly caused him to work 55 to 60 hours per week and willfully refused to properly compensate his overtime hours.

The plaintiff requests a trial by jury and seeks compensation for unpaid wages, an additional equal amount of liquidated damages, attorney's fees and costs and for such other remedy that the court may deem just and appropriate. He is represented by James M. Loren of Loren Law Group in Plantation.
