Broward County man accuses Quay Partners, Shula Burger of disability discrimination

MIAMI – A disabled Broward County man alleges a Fort Lauderdale business and its property owners have discriminated against him and others who are similarly situated by denying them safe access or accommodation to their property.

Lional Dalton filed a complaint on April 6 in the U.S. District Court for the Southern District of Florida against Quay Partners LLC and SB One Enterprises, doing business as Shula Burger, citing disability discrimination and failure to uphold Americans with Disabilities Act regulations.

According to the complaint, the plaintiff alleges that on March 28 he encountered barriers to access the defendants' facility and was denied full and equal access and enjoyment of the goods, services and amenities within the property. He alleges he has suffered and will continue to suffer legal harm and legal injury as a result of the illegal barriers to access the facility. The plaintiff holds Quay Partners LLC and Shula Burger responsible because the defendant allegedly failed to provide an accessible restroom, failed to provide disabled parking, and failed to provide signage directing disabled individuals as to where services are provided for individuals with disabilities.

The plaintiff requests a trial by jury and seeks an order requiring the defendants to alter the property to make it accessible to individuals with disabilities, an order directing defendants to evaluate their policies and procedures toward persons with disabilities, reasonable attorneys' fees, costs, expenses and for such other further relief as the court may deem necessary, just and proper.
