MIAMI – A purchasing and shipping agent alleges that he was not paid overtime while he worked for his former employer.
Yelithze Del Carmen Useche filed a complaint on behalf of all others similarly situated on April 5 in the U.S. District Court for the Southern District of Florida against ABC Components Inc. and Mine Gulec alleging that they violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that between Feb. 26, 2014, and Jan. 9, 2016, he did not receive overtime and/or minimum wages for work performed in excess of 40 hours weekly. The plaintiff holds ABC Components Inc. and Mine Gulec responsible because the defendants allegedly refused to pay overtime wages and/or minimum wages for all extra hours worked and recklessly failed to investigate whether its payroll practices were in accordance with the FLSA.
The plaintiff requests a trial by jury and seeks compensation for all overtime wages, double damages, reasonable attorney fees, costs, interest and any other relief that the court may find reasonable under the circumstances. He is represented by J.H. Zidell of J.H. Zidell PA in Miami Beach.
