Former managers allege Beall's Inc. did not pay overtime wages

MIAMI – Two former area managers have filed a class-action lawsuit against a retail store over allegations that they were not paid overtime during their employment.

Eric Maar and Lindiane Wess filed a complaint on behalf of all others similarly situated on April 5 in the U.S. District Court for the Southern District of Florida against Beall's Inc. alleging violation the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that they did not receive overtime premium pay during their employment. The plaintiffs holds Beall's Inc. responsible because the defendant allegedly failed to pay proper overtime wages for hours they worked in excess of 40 hours in a work week and failed to keep accurate records of all hours they worked.

The plaintiffs request a trial by jury and seek compensation for unpaid wages and liquidated damages, prejudgment and post-judgment interest, attorneys’ fees and costs and for such other relief as the court may deem just and proper.
