Dade County resident seeks allegedly unpaid overtime wages from Pacific Glass

MIAMI – An assistant installer has filed a class-action lawsuit against his former employer over allegations he was not paid overtime wages.

Luis S. Romero filed a complaint on behalf of all others similarly situated on April 2 in the U.S. District Court for the Southern District of Florida against Pacific Glass Corp. and Eduardo Arrastia, alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between Jan. 14 and Feb. 20, he worked more than 49 hours a week and was paid straight pay only instead of the extra half-time rate for all hours worked over 40 hours in a week. The plaintiff holds Pacific Glass Corp. and Arrastia responsible because the defendants allegedly refused to pay overtime premiums as required by law and recklessly failed to investigate whether its’ payroll practices were in accordance with the law.

The plaintiff requests a trial by jury and seeks compensation for all overtime wages due, double damages, reasonable attorney fees, court costs and interest and for any other relief that the court may find reasonable under the circumstances.
