Miami Dade County resident accuses The Home Depot of racial discrimination

Wrongful term 09

MIAMI – A Haitian African-American alleges that his home improvement store employer terminated him because of his race.

Jean Gardye Ledrake Pierre filed a complaint on April 4 in the U.S. District Court for the Southern District of Florida against The Home Depot alleging that the employer violated the Civil Rights Act.

According to the complaint, the plaintiff alleges that he has been deprived of his rights, embarrassed, and has suffered personal damage and emotional distress. The plaintiff holds The Home Depot responsible because the defendant allegedly subjected him to a pattern and practice of discriminatory treatment by non-black agents, failed to make prompt remedial action to prevent continued discrimination and terminated him under the presumption that he was involved in a robbery, but he was never charged. The suit states he was terminated on Oct. 24, 2015.

The plaintiff requests a trial by jury and seeks judgment that defendant violated the law, an order for his reinstatement, compensation for all damages, including back pay and benefits, prejudgment interest, attorney's fees and costs and for any additional relief that the court may deem just under the circumstances. He is represented by Anthony M. Georges-Pierre of Remer & Georges-Pierre PLLC in Miami.
