Former cook alleges Pizza Point I did not pay him overtime

MIAMI – A cook has filed suit against his former employers over allegations he was not paid overtime wages when he worked more than 40 hours a week.

Edwin Basil Ferrufino Sanchez filed a complaint on behalf of himself and all others similarly situated on April 1 in the U.S. District Court for the Southern District of Florida against Pizza Point I Inc. and Ashwani Kumar, alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that, between May 5, 2003, and Feb.17, he did not receive overtime and minimum wages for all extra hours he worked. The plaintiff holds Pizza Point I Inc. and Kumar responsible because the defendants allegedly failed to compensate him at a rate of time-and-one-half of his regular rate for all hours worked in excess of 40 in a single week and recklessly failed to investigate whether their payroll system was in accordance with the law.

The plaintiff requests a trial by jury and seeks compensation for all overtime wages due, double damages, reasonable attorney fees, all court costs, interest and any other relief that the court may find reasonable under the circumstances.
