Insurance 08

ORLANDO – A registered nurse alleges that he was wrongfully terminated from receiving disability benefits.

Jae Lawrence filed a complaint on April 4 in the U.S. District Court for the Middle District of Florida, Orlando Division against The Lincoln National Life Insurance Co. alleging that the claims administrator violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he discontinued working in July 2014 because of his disabilities. The suit states he applied and received long-term disability benefits that October. The plaintiff holds The Lincoln National Life Insurance Co. responsible because the defendant allegedly terminated his benefits in May 2015, failed to discharge its duties in respect to discretionary claims and ignored the medical records and clear opinion of his physicians.

The plaintiff requests a trial by jury and seeks compensation for unpaid benefits, interest, attorneys' fees and costs of litigation and for such other relief that the court may deem just and proper. He is represented by Geannina A. Burgos and Edward Philip Dabdoub of Wagar Dabdoub PA in Coral Gables.
