Man alleges Fast Tine, Geneva Bays property not ADA compliant

MIAMI – A Broward County man alleges that a Deerfield Beach business has barriers that restrict access to the disabled.

Lional Dalton filed a complaint on April 1 in the U.S. District Court for the Southern District of Florida against Geneva Bays LLC and Fast Tint LLC alleging that they violated the Americans with Disabilities Act Accessibility Guidelines.

According to the complaint, the plaintiff alleges that he experienced serious difficulty accessing the defendants' facility on March 29 due to the architectural barriers in place and was denied equal enjoyment of the goods and services offered at the property. The plaintiff holds Geneva Bays LLC and Fast Tint responsible because the defendants allegedly failed to make the facility easily accessible to individuals with disabilities, failed to provide proper signage to the closest available accessible restroom and failed to provide painted sign(s) on the ground for disabled parking.

The plaintiff requests a trial by jury and seeks an order requiring defendant to alter the property to make it accessible to individuals with disabilities, an order directing defendants to evaluate their policies and procedures toward persons with disabilities, reasonable attorney's fees and costs and any further relief as the court may deem necessary.
