MIAMI – Former restaurant employees allege that they were not paid overtime and have filed a suit against their previous employers.
Elvin Enrique Benites Argueta, Camilo Cuenu Colorado, Harry Humberto Cuadra Garay, Felix Alexander Gama, Egidio Orellana Ortiz, Juan Hilario Peralta Severino, Leandro Gabriel Robles Garcia, Martin Secundo-Gonzalez, Jose Luis Secundo Gonzalez and Marcos Sales Domingo filed a complaint on April 1 in the U.S. District Court for the Southern District of Florida against Newcor LLC, doing business as La Parrilla, Rafael Arvelo and Maximo Arvelo alleging that they knowingly violated the Fair Labor Standards Act.
According to the complaint, the plaintiffs allege that they did not receive any compensation for all their overtime hours throughout their employment. The plaintiffs holds Newcor LLC, Rafael Arvelo and Maximo Arvelo responsible because the defendants allegedly failed to compensate them at the rate of time-and-one-half of their hourly rate of pay for those hours worked in excess of 40 hours per week, failed to give them any justification for withholding the tips or an explanation as to the amount the they ultimately received.
The plaintiffs request a trial by jury and seek compensation for unpaid overtime wages found to be due and owing, prejudgment interests, reasonable attorney’s fee and costs and for such other relief as the court may deem just and equitable.
