Broward County resident accuses Memorial Healthcare System of telephone harassment

MIAMI – A man alleges a health care facility has repeatedly called his cellphone in an attempt to reach an unknown party.

Jimmy Grinberg filed a complaint on April 1 in the U.S. District Court for the Southern District of Florida against South Broward Hospital District, doing business as Memorial Healthcare System, citing violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that he has received several unwanted telephone calls from the defendant for a person he doesn't know. The plaintiff holds Memorial Healthcare System responsible because the defendant allegedly made non-emergency calls using an automatic telephone dialing system and/or pre-recorded or artificial voice messages, which is a violation of the TCPA.

The plaintiff requests a trial by jury and seeks a permanent injunction prohibiting defendant from placing non-emergency calls to his cellular telephone, compensation for damages and for other or further relief as the court may deem proper.
