Palm Beach County resident accuses Burger King location of violation of ADA

FORT LAUDERDALE – A disabled man is suing a fast-food restaurant alleging he was denied equal access due to barriers at the restaurant.

Santiago Abreu filed a complaint on April 1 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Goldco LLC, doing business as Burger King, alleging that it violated the Americans with Disabilities Accessibility guidelines.

According to the complaint, the plaintiff alleges that on Feb. 18 he was denied full and equal enjoyment of the goods, services advantages, and/or accommodations offered at the defendant's facility. He alleges to have suffered, and will continue to suffer, direct and indirect injury as a result of defendant's discrimination. The plaintiff holds Goldco LLC responsible because the defendant allegedly failed to provide restrooms that are easily accessible to individuals with disabilities.

The plaintiff requests a trial by jury and seeks an order for defendants to alter the subject facility to make it readily accessible to and useable by individuals with disabilities, an order directing defendant to evaluate its policies towards persons with disabilities, reasonable attorney’s fees, costs and expenses and for such other and further relief as it may deem necessary, just and proper.
