Former employees allege Accurate Land Surveyors did not pay overtime

MIAMI – Two field crew members are suing their former employers over claims that they were not paid overtime wages.

James Daniel Swarthout and Daniel Thomas Williams filed a complaint on March 30 in the U.S. District Court for the Southern District of Florida against Accurate Land Surveyors Inc., Robert L. Thompson and Christopher Carvell alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that they did not receive full and proper overtime wages during their employment with the defendants. The plaintiffs holds Accurate Land Surveyors Inc., Robert L. Thompson and Christopher Carvell responsible because the defendants allegedly willfully refused to properly compensate them at time-and-one-half of their hourly rate for each hour they worked in excess of 40 hours in a work week.

The plaintiffs request a trial by jury and seek compensation for unpaid overtime wages, liquidated damages, attorney’s fees, costs and interest and such other remedy as the court may deem just and appropriate. They are represented by Elliot Kozolchyk of Koz Law PA in Fort Lauderdale.
