ORLANDO – A Louisiana company authorized to do business in Florida has filed a suit against a Pennsylvania corporation alleging it owes an outstanding debt.
Amerifactors Financial Group LLC filed a complaint on March 30 in the U.S. District Court for the Middle District of Florida, Orlando Division against Westwood Generation LLC alleging that the electric service company failed to comply with their payment agreement.
According to the complaint, the plaintiff alleges that it entered into an agreement with Kimmel Power Plant Service Inc. to collect a debt of $488,402.36 the defendant purportedly owed to Kimmel. The plaintiff holds Westwood Generation LLC responsible because the defendant allegedly agreed to pay the total amount without dispute and agreed to waive its rights to assert any defense on paying the amount. The defendant allegedly also failed or refused to respond to the plaintiff's demand for payment of said account.
The plaintiff requests a trial by jury and seeks payment for damages in the amount of $488,402.36, plus interest and costs for this action. It is represented by Charles C. Lane of Lau, Lane, Pieper, Conley & McCreadie PA in Tampa.
