Government agency sues borrower over allegedly unpaid education loan

MIAMI – The federal government agency is suing a Miami-Dade County man alleging failure to pay on a loan of several thousand dollars.

United States of America filed a complaint on March 30 in the U.S. District Court for the Southern District of Florida against Arthur Barnes, alleging that the borrower failed to comply with their loan agreement through the U.S. Department of Education.

According to the complaint, the plaintiff alleges that it did not receive payment in the amount of $126,797.88, excluding attorney's fees and cost of insurance and freight charges. The plaintiff holds Arthur Barnes responsible because the defendant allegedly has neglected and refused to pay the loan.

The plaintiff requests a trial by jury and seeks payment for the loan amounting to $126,797.88, prejudgment and post-judgment interest, attorneys' fees and costs and such other relief which the court may deem proper. It is represented by Jennifer Margolis Marquez of Newman & Marquez PA in Coral Gables.
