WEST PALM BEACH – Two Palm Beach County residents allege that their former employer did not pay them overtime.
Douglas Heyer and Melissa Nermesan filed a complaint on March 29 in the U.S. District Court for the Southern District of Florida West Palm Beach Division against Services Unlimited LLC alleging that the former employer violated the Fair Labor Standards Act and the Federal Declaratory Judgment Act.
According to the complaint, the plaintiffs allege that they did not receive payment of time-and-one-half of their statutory hourly rate for all hours they worked in excess of 40 hours in a work week during their employment. The plaintiffs holds Services Unlimited LLC responsible because the defendant allegedly misclassified them as exempt employees, failed to properly compensate them for their extra hours worked and failed to maintain proper time records as required by law.
The plaintiffs request a trial by jury and compensation for unpaid wages, an additional equal amount as liquidated damages, attorney's fees and costs, prejudgment interest and any further relief that the court may deem just and proper.
