MIAMI – A former Xerox Business Services employee alleges that she is disabled and that her insurance company wrongfully denied long-term disability benefits.
Sherry Christopher filed a complaint on March 30 in the U.S. District Court for the Southern District of Florida against Metropolitan Life Insurance Co. alleging that the claims administrator violated the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that she became disabled in November 2013 and applied for disability benefits. She alleges the defendant denied her claim in July 2014 stating it did not consider her to be disabled. The plaintiff holds Metropolitan Life Insurance Co. responsible because the defendant allegedly failed to provide a prompt and reasonable explanation of the termination of her claim for long-term disability benefits and failed to properly and adequately investigate the merits of her disability claim.
The plaintiff requests a trial by jury and seeks an order declaring that she is entitled to immediate reinstatement to the plan, attorneys’ fees and costs, prejudgment and post-judgment interest and any further relief as the court may deem just and proper.
