Former employees allege Loewen Decor did not pay overtime wages

MIAMI – Two carpenters have filed a class-action lawsuit against their former employers over allegations that they were not paid overtime.

Donys Francisco Gonzalez Mercado and Ernesto Jose Hernandez Amador filed a complaint on behalf of themselves and all others similarly situated on March 29 in the U.S. District Court for the Southern District of Florida against Loewen Decor Inc. and Andres S. Lowentraut alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that they did not receive overtime pay or minimum wages for work they performed in excess of 40 hours in a week during their entire employment. The plaintiffs holds Loewen Decor Inc. and Andres S. Lowentraut responsible because the defendants allegedly intentionally refused to compensate them for all their extra hours worked and recklessly failed to investigate whether their payroll practices were in accordance with the FLSA.

The plaintiffs request a trial by jury and seek compensation equal to double damages, reasonable attorney fees, costs and interest and any other relief that the court may find reasonable under the circumstances. They are represented by J.H. Zidell of J.H. Zidell PA in Miami Beach.
