MIAMI – A janitor is suing his current employer alleging he was not paid overtime wages.
Herley Velez filed a complaint on March 29 in the U.S. District Court for the Southern District of Florida against Coastal Building Maintenance Inc., alleging that the building maintenance provider violated the Fair Labor Standards Act and breach of contract.
According to the complaint, the plaintiff alleges that between March 29, 2013, and Oct. 29, 2015, he suffered a loss of unpaid overtime wages totaling $23,388.22. The plaintiff holds Coastal Building Maintenance Inc. responsible because the defendant allegedly failed to pay overtime pay for all hours he worked in excess of 40 in a week.
The plaintiff requests a trial by jury and seeks compensation for unpaid wages, liquidated damages, interest, and attorney’s fees and costs and such other remedy as the court may deem just and appropriate. He is represented by James M. Loren of Goldberg & Loren PA in Plantation.
