FORT LAUDERDALE – A person with disabilities is suing a shopping plaza, alleging that the barriers on the property have endangered his safety.
Douglas Longhini filed a complaint on March 23 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against 2800 Weston Road Associates LTD, doing business as Millennium Plaza, citing alleged failure to uphold Americans with Disabilities Act regulations.
According to the complaint, the plaintiff alleges that he suffered irreparable harm and was denied equal enjoyment of the goods and services offered at the property. The plaintiff holds Millennium Plaza responsible because the defendant allegedly failed to have an accessible facility for persons with disabilities and failed to make reasonable modifications in policies to provide full and equal enjoyment to disabled individuals.
The plaintiff requests a trial by jury and seeks a declaratory judgment determining that defendant is in violation of Title III of the ADA, an order to make its property readily accessible to and usable by individuals with disabilities, attorney’s fees, costs and litigation expenses and any further relief as the court may deem just and proper.
