Woman alleges Prudential wrongfully denied benefits

Insurance 06

MIAMI – An employee of Automatic Data Processing has filed a suit against an insurance company alleging it wrongfully denied her long-term disability benefits.

Teresa Glover filed a complaint on March 22 in the U.S. District Court for the Southern District of Florida against The Prudential Insurance Co. of America alleging that the insurer wrongfully violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that from May 20, 2014, to the present date, she has not received benefits under the plan. The plaintiff holds The Prudential Insurance Co. of America responsible because the defendant allegedly failed to pay her benefits under the plan, failed to provide reasonable explanation for denying the claim and failed to properly investigate the merits of the disability claim.

The plaintiff requests a trial by jury and seeks payment of disability benefits due, an order for her immediate reinstatement to the plan, all costs and attorneys’ fees, prejudgment and post-judgment interest and any further relief as the court may deem just and proper. She is represented by Cesar Gavidia and Gregory Michael Dell of Attorneys Dell & Schaefer Chartered in Hollywood.
