ORLANDO – A Volusia County woman is suing a debt collector alleging abuse and violation of telephone harassment statutes.
Aida Sacca filed a complaint on March 21 in the U.S. District Court for the Middle District of Florida, Orlando Division against Navient Solutions Inc., citing violations of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.
According to the complaint, the plaintiff alleges that she frequently received non-emergency calls several times per day from the defendant. The plaintiff holds Navient Solutions Inc. responsible because the defendant allegedly placed calls using an automatic telephone dialing system or a pre-recorded or artificial voice messages.
The plaintiff requests a trial by jury and seeks permanent injunction prohibiting defendant from placing non-emergency calls to her cellular telephone; compensation for statutory, actual and punitive damages; attorney’s fees, costs and expenses; and any further relief that the court may deem proper.
