United Guaranty Residential Insurance Co. of North Carolina accused of violating debt laws

TAMPA – A Pasco County resident is accusing a North Carolina company of violations of debt collection laws.

Raymond Fernandez filed a complaint on behalf of himself and all similarly situated individuals on March 17 in the Tampa Division of the Middle District of Florida against United Guaranty Residential Insurance Co. of North Carolina alleging violations of the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges the defendant filed a suit against him in November 2015 after he allegedly fell into arrears on his home equity line of credit. He alleges this suit is in violation of the FDCPA and FCCPA because it falsely lists name of the lender and because the defendant failed to send him any notice of assignment before filing the suit.

The plaintiff requests a trial by jury and seeks a certification for this action to proceed as a class action, an award of statutory and actual damages, attorneys' fees and costs and any further relief that the court may deem just and equitable. He is represented by Luis A. Cabassa and Brandon J. Hill of Wenzel Fenton Cabassa PA in Tampa.
