Man files suit against Life Insurance Co. of North America over benefits dispute

MIAMI – A man diagnosed with chronic myegenous leukemia alleges his insurance company first approved and then denied his disability benefits.

Frederick Gore filed a complaint on March 16 in the U.S. District Court for the Southern District of Florida against Life Insurance Co. of North America, alleging that the plan administrator wrongfully violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he has suffered damages for loss of disability benefits in 2015. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly failed to properly investigate the merits of his disability claim and failed to provide a full and fair review of his claim.

The plaintiff seeks the following: compensation for disability benefits due; an order to immediately reinstate him to the long-term disability plan; prejudgment and post-judgment interest; attorney’s fees and costs; and any further relief as the court may deem just and proper. He is represented by Cesar Gavidia and Gregory Michael Dell of Attorneys Dell & Schaefer Chartered in Hollywood.
