MIAMI – A man is suing his former employer over allegations that his retirement plan suffered losses.
Luis S. Rosero-Barros filed a complaint on March 15 in the U.S. District Court for the Southern District of Florida, Miami Division against NextLevel Information Solutions Inc., George Doris and NextLevel Information Solutions IRA Plan, citing violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that his retirement plan suffered injury and losses. The plaintiff holds NextLevel Information Solutions Inc., George Doris and NextLevel Information Solutions IRA Plan responsible because the defendants allegedly failed to ensure that the plaintiff's contributions were deposited in the employee retirement plan account and failed to make employer-made contributions to the retirement plan.
The plaintiff seeks the following: a permanent injunction enjoining defendants from violating the provisions of Title I of ERISA; an order removing defendants from their positions as fiduciaries with respect to the retirement plan; attorney’s fees and costs; and any further relief that are just and appropriate.
