Former server alleges Il Gabbiano Miami did not pay overtime

MIAMI – A Miami man alleges his former employer did not pay him overtime pay.

Danilo Jovanovic on March 15 in the U.S. District Court for the Southern District of Florida against Il Gabbiano Miami LLC and Gino Masci citing violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between Dec. 29, 2015, and March 2, 2016, he did not receive overtime compensation for all hours worked in excess of 40 per week. The plaintiff holds Il Gabbiano Miami LLC and Gino Masci responsible because the defendants allegedly failed to pay his lawfully earned wages and failed to apprise him of his rights under the FLSA.

The plaintiff seeks the following: compensation for unpaid wages due and liquidated damages; attorney’s fees and costs; post-judgment interest; and any further relief that the court may deem just and proper. He is represented by Peter Bober and Samara Bober of Bober & Bober PA in Hollywood.
