MIAMI – A woman alleges her insurance company wrongfully terminated her benefits.
Lisa Dodge filed a complaint on March 14 in the U.S. District Court for the Southern District of Florida against Life Insurance Co. of North America alleging that it violated the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that from June 7, 2015, to the present date, she has not received benefits due to her under the long-term disability plan. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly refused to pay her benefits, failed to provide a reasonable explanation of the basis for the termination of her disability claim and failed to properly investigate the merits of her claim.
The plaintiff seeks the following: a declaration that she is entitled to immediate reinstatement to the plan; compensation for disability benefits due; attorneys’ fees and costs; prejudgment and post-judgment interest; and any further relief that the court may deem just and proper.
