U.S. American Concrete Mix accused of not paying wages

MIAMI – A Miami-Dade County man is suing is former employer over allegations he wasn't paid for all time worked.

Sergio L. Acebal filed a complaint on March 11 in the U.S. District Court for the Southern District of Florida against U.S. American Concrete Mix Corp. and Jorge Rodriguez, citing violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that, between Sept. 9, 2015, and Feb. 11, he did not receive proper overtime wages calculated at time-and-one-half of his regular rate of pay for all hours worked over 40 hours per week. The plaintiff holds U.S. American Concrete Mix Corp. and Rodriguez responsible because the defendants allegedly failed to pay the overtime premiums owed to him.

The plaintiff seeks the following: compensation for all wages due and an equal amount of liquidated damages, attorneys fees, costs and interest and any further relief that the court may deem just and proper. He is represented by Brian H. Pollock of FairLaw Firm in Miami.
