Woman alleges collectors did not remove disputed debt from credit report

MIAMI – A Broward County woman alleges that a debt collector has violated regulations in attempting to collect from her.

Marrianne Errante filed a complaint on March 10 in the U.S. District Court for the Southern District of Florida against CMRE Financial Services Inc. and CMRE Financial Services Inc., citing alleged violation of the Fair Debt Collections Practices Act and the Florida Consumer Collection Practices Act regulations.

According to the complaint, the plaintiff alleges that on Jan. 25, she discovered when examining her credit report that the defendants had not removed the disputed alleged debt they were trying to collect nor marked it as "disputed by consumer," despite being required by the FDCPA. The plaintiff holds CMRE Financial Services Inc. responsible because the defendants allegedly failed to update their report to reflect the disputed status.

The plaintiff seeks the following: compensation for all damages, attorneys' fees and costs and any further relief that the court may deem just and proper. She is represented by Michael Jay Ringelheim of RC Law Group PLLC in Hackensack, New Jersey.
