MIAMI – A woman alleges her insurance company wrongfully denied her benefits and an external review.
Ashlee Howard filed a complaint on March 10 in the U.S. District Court for the Southern District of Florida, Miami Division against Aetna Life Insurance Co. and Graham Holdings Co. Flexible Benefits Program, claims and plan administrators, citing violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that her doctors recommended inpatient treatment at a clinic in late 2013. The plaintiff holds Aetna Life Insurance Co. and Graham Holdings Co. Flexible Benefits Program responsible because the defendants allegedly denied her medical coverage benefits for the treatment and purportedly refused to grant her request for an external review as part of the appeal process.
The plaintiff seeks the following: unpaid medical coverage, attorneys' fees and costs and any further relief that the court may deem just and proper. She is represented by Edward P. Dabdoub and Geannina Burgos of Wagar Dabdoub PA in Miami.
